The Tribunal having considered the Complaint at the instance of the Council of the Law Society of Scotland against Kevin Frederick MacPherson, Ravenswood House, PO Box 9945, Stornoway, Isle of Lewis; Find the Respondent guilty of professional misconduct in respect that between March 2011 and August 2013 he engaged in an improper course of conduct towards a trainee solicitor and on 22 June 2012 engaged in an improper course of conduct whereby he engaged in email correspondence with a female employee of another firm of solicitors in which he made reference to the statement of a child complainer in a case of alleged sexual abuse against a client of his firm in terms which demonstrated that he found the content of the said child statement to be titillating or sexually gratifying; Order that the name of the Respondent be Struck Off the Roll of Solicitors in Scotland; Find the Respondent liable in the expenses of the Complainers and of the Tribunal including expenses of the Clerk, chargeable on a time and line basis as the same may be taxed by the Auditor of the Court of Session on an agent and client, client paying basis in terms of Chapter Three of the last published Law Society’s Table of Fees for general business with a unit rate of £14.00; and Direct that publicity will be given to this decision and that this publicity should include the name of the Respondent but need not identify any other person.
